Terms of Service
The general agreement between Hybreu Digital LLC and everyone who uses our websites and products.
Please read these terms carefully. By using any Hybreu Digital product or website you agree to be bound by them. If you do not agree, do not use the product.
1. Who we are and what these terms cover
Hybreu Digital LLC ("Hybreu Digital", "we", "us") is a Florida limited liability company based in Miami, Florida. We publish software products, including ABAIQ (a Chrome extension, web platform and QA Suite for Applied Behavior Analysis documentation), ABAIQ Learn (an iOS audio app for the RBT, BCaBA and BCBA exams) and Citizenship Learn: Civics Test (an iOS audio app for the U.S. naturalization civics test). Together with this website, hybreu.com, we call them the "Products".
These Terms of Service ("Terms") apply to every Product. Each Product also has its own product terms, listed above. If a product term conflicts with these Terms, the product term controls for that Product. For ABAIQ, the full ABAIQ Terms of Service, Business Associate Agreement and QA Suite Terms of Use published at abaiq.ai remain the governing agreements for that Product; the ABAIQ page on this site summarizes them.
2. Acceptance
You accept these Terms by creating an account, checking an acceptance box, starting a subscription, installing or opening an app, or using a Product in any way. If you accept on behalf of an organization, you represent that you have authority to bind it.
3. Eligibility and accounts
You must be at least 18 years old to create an account or buy a subscription. Where a Product uses accounts, you are responsible for keeping your credentials confidential and for everything that happens under your account. Tell us at support@abaiq.ai if you suspect unauthorized use.
4. Subscriptions, payments and refunds
Web subscriptions (ABAIQ). Fees are shown at the time of purchase in U.S. dollars and are processed by a third-party payment provider; we never store your full card number. Subscriptions renew automatically at the end of each billing cycle until you cancel from your dashboard. Cancellation takes effect at the end of the current cycle. Because ABAIQ offers a free tier that lets you evaluate it before paying, all paid charges are final and non-refundable, including charges that result from selecting the wrong plan or billing interval. Unused note or credit allowances do not roll over unless the product terms say otherwise.
App subscriptions (ABAIQ Learn, Citizenship Learn and future apps). Subscriptions in our iOS apps are sold through Apple In-App Purchase and billed to your Apple ID. Apple manages the charge, the automatic renewal, cancellation and any refund under Apple's terms. You can cancel at any time from your Apple ID settings; you keep access until the end of the period already paid. We do not receive your payment details from Apple.
We may change prices with reasonable advance notice to active subscribers; a change applies from your next renewal.
5. Intellectual property and license
The Products, including their software, design, audio, text, explanations, handouts, images, branding and trademarks, are owned by Hybreu Digital LLC or its licensors and are protected by copyright and trademark law. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Products for your own use. You may not copy, record, download outside the app, screen-capture, share, lend your account, redistribute, publish, broadcast, resell, reverse engineer or create derivative works from any Product or its content.
Content that belongs to you stays yours. Clinical notes that ABAIQ drafts from your inputs belong to you. Questions and answers published by the U.S. government, such as the USCIS civics test questions, are in the public domain; our recordings, explanations and materials built around them are ours.
6. Acceptable use
You agree not to use any Product to break the law, to infringe anyone's rights, to upload malicious code, to interfere with the service or its infrastructure, to share credentials or content with people who are not authorized to receive them, or to misrepresent AI-generated output as human-written where disclosure is required. Each product page lists additional rules for that Product.
7. AI-generated content and professional judgment
Some Products use artificial intelligence. Everything an AI feature produces is a draft. You are responsible for reviewing, editing and approving it before you rely on it, and you keep full professional responsibility for any decision you make with it. Our Products are not medical devices and do not provide medical, clinical, legal, immigration, financial or other professional advice.
8. Educational content and results
Our learning apps help you prepare. They do not guarantee that you will pass any exam, obtain any credential or achieve any outcome. Exam content and rules change over time; always confirm current requirements with the body that administers your exam.
9. Third parties and no affiliation
Our Products are independent. They are not affiliated with, sponsored by or endorsed by U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security, the Behavior Analyst Certification Board (BACB), the Council of Autism Service Providers (CASP), Apple, Google or any practice-management, electronic-health-record or government body. RBT, BCaBA and BCBA are trademarks of the BACB. All other trademarks belong to their owners. Where a Product works alongside a third-party platform, you are responsible for complying with that platform's terms.
10. Disclaimer of warranties
The Products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Products will be uninterrupted, error-free or secure, or that AI output will be accurate or complete.
11. Limitation of liability
To the maximum extent permitted by law, Hybreu Digital LLC will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages, including loss of data, loss of profits, professional sanctions, regulatory fines or business interruption. Our total liability for any claim related to a Product will not exceed the amount you paid us for that Product in the three months before the claim.
12. Indemnification
You agree to defend, indemnify and hold harmless Hybreu Digital LLC and its members, managers, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or third-party right, or your use of a Product's output.
13. Suspension and termination
We may suspend or terminate your access to a Product, with or without notice, if we reasonably believe you have breached these Terms or the applicable product terms. You may stop using a Product at any time; for web accounts, write to support@abaiq.ai to request deletion. Sections 5, 7, 10, 11, 12 and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or a Product will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. The prevailing party may recover reasonable attorneys' fees and costs.
15. Changes to these terms
We may update these Terms. Each version is posted here with its effective date. A change that materially affects your rights or obligations will be notified in the Product or by email before it takes effect; continued use after that date means you accept the revised Terms.
16. General
These Terms, the Privacy Policy and the applicable product terms are the entire agreement between you and us about the Products. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
